Welcome to Emmygrow Concepts. These Terms & Conditions (“Terms”) apply to your use of emmygrowconcepts.com.ng and to enquiries for or purchase of our website design, WordPress development, e-commerce, landing page, branding, UI/UX and related services. By using the website or engaging our services, you agree to the applicable Terms.

1. Our Services

Emmygrow Concepts provides digital design and development services. The precise scope, deliverables, timeline, fees, revision allowance, support period and other project-specific conditions will be set out in a quotation, proposal, invoice or written agreement accepted by both parties. If a project-specific written agreement conflicts with these Terms, that agreement will apply to the extent of the conflict.

2. Enquiries and Quotations

Submitting an enquiry or quote request does not by itself create a contract or guarantee acceptance of a project. Quotations are based on the information available when prepared and may be revised if requirements change, important information was omitted, or the quotation expires. A project begins when the scope and applicable commercial terms have been accepted in writing and any agreed initial payment has been received.

3. Client Responsibilities

You agree to provide accurate project information, required text, images, branding materials, access credentials and feedback in a timely manner. You must have the rights and permissions needed to provide any materials you supply. You are responsible for reviewing and approving content, functionality and deliverables, and for ensuring that your website and business activities comply with laws and industry rules that apply to you.

4. Fees and Payments

Fees, payment milestones, due dates and any applicable taxes or third-party costs will be stated in the accepted quotation or invoice. Work may be paused where an agreed payment is overdue, after reasonable notice where appropriate. Domain names, hosting, premium plugins, paid themes, stock assets, payment-gateway charges and other external services are included only if expressly stated in the project agreement.

5. Revisions, Changes and Delays

Included revisions and approval stages will be defined in the project agreement. Requests that materially change the agreed scope, add features or require substantial rework may require a revised quote and timeline. Delays in receiving content, access, approvals or payments may affect delivery dates. We will communicate material changes to the schedule or scope.

6. Intellectual Property

Unless otherwise agreed in writing, pre-existing tools, methods, reusable components, know-how and materials owned or licensed by Emmygrow Concepts remain the property of their respective owners. Upon full payment, ownership or usage rights in the specifically commissioned final deliverables will transfer to you as described in the accepted project agreement. Third-party software, fonts, themes, plugins, images and other assets remain subject to their own licences. We may request permission to display completed work in our portfolio; we will not treat that permission as granted where you have expressly declined it in writing.

7. Website Launch, Hosting and Third-Party Services

Where included in the agreed scope, we may assist with deployment, hosting configuration, domain connection, integrations or third-party services. Availability, pricing, features and policies of external providers are outside our control. Unless expressly included in writing, ongoing hosting, domain renewal, software subscriptions, maintenance and content updates remain the client’s responsibility.

8. Support and Maintenance

Post-launch support, maintenance, backups, security monitoring, updates and response times are provided only to the extent stated in the project agreement or a separate support plan. Without such an agreement, additional work requested after project completion may be quoted separately.

9. Acceptable Use

You must not misuse this website, attempt unauthorised access, interfere with its operation, introduce malicious code, infringe another person’s rights, or use our services for unlawful, fraudulent or harmful activities. We may restrict access or suspend work where reasonably necessary to protect our systems, people or legal interests.

10. Cancellations and Refunds

If either party wishes to end a project, the parties should refer to the cancellation terms in the accepted quotation or written agreement. You remain responsible for fees for work completed and non-cancellable third-party costs properly incurred up to the effective cancellation date, subject to applicable law and any agreed refund terms. No additional refund or cancellation condition is created by this section where the project agreement already addresses it.

11. Warranties and Limitation

We will use reasonable care and skill in providing the agreed services. Unless expressly stated in writing, we do not guarantee particular sales, search rankings, traffic levels, uninterrupted third-party services or business outcomes. To the maximum extent permitted by applicable law, Emmygrow Concepts will not be liable for indirect or consequential loss arising from use of the website or services. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits your mandatory rights under applicable law.

12. Privacy

Our handling of personal information is explained in our Privacy Policy, which forms part of the information governing your use of this website.

13. Changes to These Terms

We may update these Terms by publishing a revised version on this page. Changes will apply from the date posted and will not retrospectively alter a signed project agreement unless the parties agree otherwise.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, subject to any mandatory legal protections that apply. Disputes should first be raised with us in good faith to seek an amicable resolution, without preventing either party from pursuing lawful remedies.
